1 – Premises and definitions
- 1.1 - Premises
  Elba-shuttle di Federico Carpinacci (heretofore known as Elba-shuttle) is a company with headquarters in Via del Sighello snc, 57034 Campo nell’Elba (Italy), VAT number 01689070496, registry number REA 149229 with the Commercial Registry of Livorno and governed by Italian law currently in force.
  Elba-shuttle offers the transportation of persons from major Italian airports to Elba Island by online bookings made on the website www.elba-shuttle.it by Elba-shuttle clients. In order to effect services, Elba-shuttle utilises the services of local transportation firms operating in the country according to the italian rules.
  Before booking online, clients must read and have understood the conditions described by Elba-shuttle which will govern their contract. Our Customer Service Department is available for eventual clarifications regarding conditions.
  
  Elba-shuttle offers the following types of transfer services on its www.elba-shuttle.it, featuring vehicles ranging from cars (1-3 passengers), minivans (4-8 passengers) to buses (from 9 to 60 passengers):
  - 1) BUSINESS TRANSFER
    The client purchases a transfer service exclusively for himself and/or the group of which he forms a part. The vehicle utilised is at the disposition of the client for the transfer service as booked. The driver will take clients from the departure point to the arrival point requested by the client.
  - 2) COMFORT TRANSFER
    The client purchases one or more seats in a specific type of vehicle and the driver will collect the client at his starting point and drop him off at his destination. The shuttle will depart at the time chosen by the client. The company is free to choose the most suitable vehicle for the transfer. The client understands that during the trip the shuttle may effect brief detours or stops in order to pick up or drop off other clients or transfer passengers from one vehicle to another during the trip. Pick-up times in these cases may be shifted ahead of scheduled time or delayed for up to an hour from the time as shown on the booking. The client accepts these possible modifications in scheduled pickup times. Elba-shuttle 's customer assistance service will inform clients (by phone) of any variations.
  - 3) SHUTTLE TRANSFER
    The client purchases one or more seats in a specific type of vehicle that will bring him from the Harbour of Piombino to Pisa Airport at a pre-established departure time; in this manner, the transfer may be shared with other passengers. The shuttle will depart at one of the hours offered by Elba-shuttle and chosen by the client. Clients are requested to be at the meeting point at least 15 minutes before the departure time as described on their booking. The client understands that during the trip the shuttle may effect brief detours or stops in order to pick up or drop off other clients or transfer passengers from one vehicle to another during the trip. Pick-up times in these cases may be shifted ahead of scheduled time or delayed for up to an hour from the time as shown on the booking. The client accepts these possible modifications in scheduled pickup times. Elba-shuttle 's customer assistance service will inform clients (by phone) of any variations.
  - 4) INTERNAL TRANSFER
    The client purchases a transfer from a departure point on the Elba Island to the arrival point on the Elba island. The vehicle utilised is at the disposition of the client for the transfer service as booked. The transfer may be shared with other passengers.
- 1.2 – Definitions
  The following conditions have to be intended for the carriage of passengers and baggage, including its corresponding reservations, made through www.elba-shuttle.it. As used in these General Conditions, the following terms will have to intended as set out below, unless otherwise specified.
  - 1.2.1 – Carrier - means, any local transportation firms that provides transportation services of passengers and baggage.
  - 1.2.2 – Passenger - means any person, except members of the crew, carried or to be carried by the carrier.
  - 1.2.3 – Adults – when referring to the applicable fare means all passengers that, at the date of travel (and in case of a round trip on the date of the return transfer) have reached the age of 12 years.
  - 1.2.4 – Children – when referring to the applicable fare means all passengers that, at the date of travel (and in case of a round trip on the date of the return transfer) have the age of 3 years to 12 years.
  - 1.2.5 - Unaccompanied Minors - means all passengers aged 12 years to 16 years on the date of the transfer(and in case of a round trip on the date of the return transfer). Elba-shuttle not accept passengers under the age of 16 unless accompanied by a passenger more than 16 years.
  - 1.2.6 - Infant - means all passengers that on the date of the transfer, and in case of a round trip on the date of the return transfer, are under the age of 3 years
  - 1.2.7 – Baggage - means all the personal property and all the objects accompanying the passenger in connection with his journey.
  - 1.2.8 - Call Centre – means Elba-shuttle, the centre for telephone assistance where all passengers can call for:
    General transfer information
    Information about online booking and purchase of tickets
    Direct purchase of tickets
    Date, time or name changes on a ticket already purchased
  - 1.2.9 – Document of Transportation or Electronic Ticket and Booking reference - mean the Document of Transportation or Electronic Ticket, issued by the booking on line system, that identify the reservation made by the passenger.
2 - Knowledge and acceptance of the present general conditions of carriage
- 2.1 – Examination of general conditions of carriage – The present general conditions of carriage must be examined by the passenger before the purchase of the ticket. This can be done either online on the website through www.elba-shuttle.it or by calling the call centre before making a reservation.
- 2.2 – Modification of general condition of carriage – The present general conditions can be updated or modified Elba Shuttle at any time; any change will by promptly notified by the carrier through the web site through www.elba-shuttle.it
- 2.3 – Acceptance of general conditions of carriage/Liability of the passenger –  The purchase of the ticket implies the full knowledge of these General Conditions of Carriage and its total acceptance; if the purchase is made online the passenger undertakes to print and keep these General Conditions of Carriage; furthermore, when a change of the booking is made, the passenger undertakes to print and keep these General Conditions of Carriage
3 – Booking and purchase
- 3.1 – Purchase methods
  - 3.1.1 – Online through our web site www.elba-shuttle.it  /li>
  - 3.1.2 – Through call centre
  - 3.1.3 – At any registered booking office at the airport
  - 3.1.4 – At any registered travel agency
- 3.2 – Ticket purchase
  - 3.2.1 – Reservation and payment at the same time – Reservation and payment must be completed at the same time. Payment of the fare, taxes, fees and charges must take place at the time of reservation. Elba-shuttle will check if the payment of the fare, taxes fees and charges applicable is correct and will send the passenger a “Travel Document” (e-ticket) with the booking reference.
  - 3.2.2 – Booking Cancellation – In case payment is not made properly, Elba-shuttle has the right to cancel the reservation.
  3.3 Comunication of the Booking reference
  - 3.3.1 Reservation through website or call center - The client will receive by e-mail a document of trasportation including a confirmation and a reference number of the booking. This e-mail is proof that you have made the booking and confirms acceptance.
  - 3.3.2 Reservation through Registered travel agency - The travel agency is responsible to all communication about details regarding the booked transfer.
- 3.4 Ticket purchase time limits
  - 3.4.1 – Purchase on line – Within 24 hrs before departure
  - 3.4.2 Purchase at any registered booking office at the airport - Within 24 hrs before departure
- 3.5 Validity of reservation - The reservation is valid until all '31.12.2012.
- 3.7 – Various -
  - 3.7.1 More passenger included in the same booking - When two or more passengers are included in the same booking, or when the booking is made by a third party, the person who makes the booking (the Client) must be considered as an agent regarding other members of the group (Passengers) and as such accepts Elba-shuttle conditions on their behalf.
- 3.8 – Control details –
  It is the client's responsibility to check all information printed on the Transport Voucher in order to confirm that the booking corresponds the the information given at the time of booking. Any errors must be communicated via email to booking@elba-shuttle.it at least 48 hrs before the transfer.
- 3.9 – Communications to passengers –
  The client is responsible for providing a valid cell phone number of at least one of the passengers, including its international prefix, for eventual communications, as departure time may vary due to bad weather or intense traffic conditions, or any other motive which might effect pickup time. If the client does not have a cell number, the client must provide the phone number of the resort where he will be staying. Any changes in pickup times will be sent by European Transfer by phone call or sms within the 24 hours preceding the transfer. It is therefore the passenger's responsibility to check for any eventual messages left by Elba-shuttle on their cell phone.
  If no contact number is given on the booking, it is the client's or passenger's responsibility to contact Elba-shuttle in order to check for any eventual variations in the booking.
  In the case of changes in pickup times or any other variation that result in the passenger's missing a transfer as a result of the client's not contacting Elba-shuttle, the client and/or passenger will not be reimbursed.
- 3.10 – Cancellation –
  If for any reason Elba-shuttle is unable to provide the service requested, the client will receive an email from Elba-shuttle cancelling the reservation. In this case, the client's credit card will not be charged.
- 3.11 - Travel document –
  The booking confirmation (e-ticket) is for all effects, the client's ticket. The voucher must be printed and presented to the Elba-shuttle driver before the transfer is to be effected. The "booking request" has no validity as a travel document.
4 – Fares and method of payment
- 4.1 - Fares –
  Fares apply only for carriage from the point of origin to the point of destination. Fares will be calculated in accordance with our Tariff in effect on the date of payment for the Ticket for the transfer
  - 4.1.1 - Refusal of carriage - We may refuse to carry you or your Baggage for reasons of safety or if the applicable Fare or any charges or taxes payable have not been paid.
    We may refuse to carry you or your Baggage for reasons of safety or if, in the exercise of our reasonable discretion, we determine that:
    - (a) such action is necessary for reasons of security;
    - (b) such action is necessary in order to comply with any applicable laws, regulations or orders of any state or country to be flown from, into or over including laws or regulations relating to Advanced Passenger Information requirements;
    - (c) your conduct, status, age or mental or physical condition or the physical condition of your Baggage is such as to:
      - (i) require our special assistance (save where the "Special Needs" provisions of our Carrier's Regulations apply);
      - (ii) cause harm, discomfort or make yourself objectionable to other passengers;
      - (iii) involve any hazard or risk to yourself or other persons or to property; or
    - (d) you have committed misconduct on a previous Flight and such conduct may be repeated;
    - (e) you have not observed, or may fail to observe, our instructions with respect to safety or security;
    - (f) you have refused to submit to a security check;
    - (g) the applicable Fare or any charges or taxes payable have not been paid, or credit arrangements agreed between us and you (or the person paying the Fare) have not been complied with;
    - (h) you do not appear to be properly documented;
    - (i) any of our documentation presented by you:
      - (i) has been acquired unlawfully or has been purchased from an entity other than us or our authorised agent;
      - (ii) has been reported as being lost or stolen;
      - (iii) is counterfeit;
      - (iv) has been altered by anyone other than us or our authorised agent, or has been mutilated; in which case we reserve the right to retain such documentation;
    - (j) the person presenting for boarding cannot prove that he is the person named as the Passenger on the Ticket.
  - 4.1.2 - Taxes and Charges - Any taxes or charges imposed by Government or other authority which we are obliged to collect from you or pay in respect of you and your transfer may be payable by you to us in addition to the Fare. At the time you make a reservation you will be advised of the total amount of such taxes and charges not included in the Fare and payable by you. Such taxes and charges imposed are constantly changing and can be imposed after the date that your reservation has been confirmed. If any such tax or charge is introduced or increased after the reservation was made you will be obliged to pay it prior to departure. Failure to make payment may affect your ability to travel with us. You authorise us to deduct such charges from the credit card or debit card used to make your booking. Similarly, if any such tax or charge due is abolished or reduced before we are obliged to pay it you will be entitled to claim a refund from us.
  - 4.1.3 – Reservation through website, call center and registered booking office at the airport - We welcome payment by any of the following methods:
    Bank transfer
    Credit card
    Note that all bank charges on money transfers are to be paid by the sender.
  - 4.1.4 - Currency - Fares, Rates and charges are payable in any currency in which the Fare or Rate is published unless otherwise agreed by us.
5 – Passenger delay -
Elba-shuttle is not responsible for verifying delays or cancellations in any flight, train, ship or other means of transport utilised by the Client. It is the Client's responsibility to immediately communicate any delays to the Elba-shuttle offices.
- 5.1 - Business Transfer - If the Client flight, train, ship or other means of transport is delayed or cancelled, the driver will wait up to 30 minutes from the scheduled arrival time. After 30 minutes, and having received communication and acceptance by the Client, a supplement of 30,00 euros will be applied for every hour or fraction thereof if the Client has booked a car or minivan up to 6 passengers and 40,00 euros for every hour or fraction thereof if the Client has booked a vehicule from 6 to 50 passengers, to be paid directly to the driver before the transfer is effected. If the Client does not inform Elba-shuttle of a delay that goes beyond the 30-minute limit, or refuses to pay above-mentioned supplement for ulterior delay, the driver will leave and the Client will have missed his transfer. No refund is given in this case.
- 5.2 – Internal trasfer - if the client is not at the pick-up point at the fixed departure time after 10 minutes, and having received communication and acceptance by the Client, a supplement of 10,00 euros will be applied for every fifteen minutes thereof if the Client has booked a car or minivan up to 6 passengers and 40,00 euros for every fifteen minutes thereof if the Client has booked a vehicule from 6 to 50 passengers, to be paid directly to the driver before the transfer is effected.
- 5.3 - Shuttle of Comfort transfer - If there is a delay or cancellation of their flight, train, ship or other means of transport, the Client will receive transport on the next available Comfort/Shuttle service. If no other shuttle service of the same type is available, the Client will be offered a business transfer if available. If the Client does not accept this alternative, he will have missed his transfer and will have no right to a reimbursement.
6 – Elba- shuttle delay –
Elba-shuttle will do everything in its power to arrive at Client's destination on time, but specifies that in no case will it be responsible for any consequences suffered by the Client as a result of transfers unable to arrive on time due to circumstances beyond the control of Elba-shuttle not directly related to the driver, such as force majeure (heavy traffic, bad weather, unexpected road detours, accidents, police road blocks, situations in which the authorities control traffic for reasons of public safety, etc).
It is possible for the Client to make a documented and well-motivated request for a refund in the amount of the transfer previously paid if the service requested was not carried out or completed, and was not a result of force majeure or the Client's own decision.
6 – Cancellations, modifications, refunds
- 6.1 – Cancellations - Booking cancellations may only be effected via email to booking@elba-shuttle and will be confirmed (via email) by Elba-Shuttle. If the Client does not receive an email confirming cancellation of service, it is the Client's responsibility to call the Elba-Shuttle offices. Booking cancellations must be made at least seven days prior to first transfer date. In this case no penalty will be applied and Elba-Shuttle will refund the cost of the booked transfer and supplements where applicable; credit card transaction fees or other method of payment charges are excluded from refund. If cancellation is effected within the seven days prior to first date of service, no refund is available to Client. Elba-Shuttle reserves the right to cancel any booking at any time if unable to guarantee transfer service in a correct manner; in this case, the Client will receive a refund for the cost of service as booked.
- 6.2 - Modifications - Modifications to be made on booked transfers and applicable supplements must be sent to booking@elba-shuttle.it at least 48 hours prior to transfer. If the Client does not receive an email confirming acknowledgement of modification, it is the Client's responsibility to call European Transfer offices. European Transfer reserves the right to refuse modifications.
- 6.3 – Refunds - Any complaints and relative requests for refunds must be sent to Elba-Shuttle at the following email address booking@elba-shuttle.it , within 30 days of transfer date.
7 – Presenting Yourself at the Boarding Point -
You should arrive at the boarding point specified in your tickets at least 15 minutes prior to the scheduled departure time.
If you arrived at the boarding point later than the scheduled departure time you will be considered to have missed the transfer. We reserve the right to give your seat to another passenger. We shall not be liable to you if you miss a transfer as a result of your late arrival. If you miss an easyBus Service We shall not be obliged to delay a trasnfer to wait for you, or provide a seat on any other transfer. No refunds shall be provided if you miss the transfer.
8 - SPECIAL ASSISTANCE
- 8.1. – Request special assistance - We need to know if you have special or additional needs before you travel with Elba-shuttle, so that we can provide you with the necessary assistance throughout your journey.
- 8.2 - Rediced mobility passengers - Passengers with disabilities or reduced mobility or their representative should contact us with details of any special assistance needs they may have on the day of booking or as soon as such needs become known but at least forty-eight (48) hours prior to travel. We will then make all reasonable efforts to verify whether there is a reason which is justified on the grounds of safety which would prevent such Passenger being accommodated on the flight(s) concerned and, if so, make reasonable efforts to propose an acceptable alternative
9 – Passenger Behaviour
Passengers must:
Wear the provided seatbelt at all times whilst the vehicle is in motion.
Behave in a reasonable, sensible and lawful manner whilst a passenger on any Elba-shuttle Vehicle or in the vicinity of an Elba-shuttle meeting point.
Comply with any request or direction from a member of staff.
Use mobile telephones considerately bearing in mind the comfort of other passengers.

Passengers must not:
Be abusive or threatening to any member of staff or any other person.
Behave in any manner that endangers or threatens the safety or security of any Elba-shuttle Vehicle, member of staff, passenger or their property.
Behave in any manner, which causes discomfort, inconvenience, damage or injury to any Elba-shuttle Vehicle, member of staff, passenger or their property.
Obstruct or allow any of their luggage to obstruct any aisle, doorway or emergency exit.
Play any radio, cassette player, or other device (electronic or otherwise) whilst on an Elba-shuttle Vehicle that is audible to any other passenger.
Take onto any Elba-shuttle Vehicle any alcoholic drinks or drugs (other than medication) with the intention of consuming them or to consume them or board any Elba-shuttle Vehicle whilst under the influence of alcohol or drugs.
Take onto any Elba-shuttle Vehicle any hot food (for example chips, kebabs) with the intention of consuming them or to consume them.
Smoke whilst on board any Elba-shuttle Vehicle.
Board any Elba-shuttle Vehicle whilst seriously ill or suffering from any contagious disease.
Passengers who fail to comply with the above rules or who we may reasonably believe will breach or continue to breach the above rules may be denied boarding of an Elba-shuttle Vehicle or be removed from an Elba-shuttle Vehicle. In such cases further carriage will be denied and the Booking cancelled without refund.
Whilst Elba-shuttle will use its reasonable endeavours to ensure compliance by passengers with the above rules, we will not be liable for any act or omission of any other passenger whilst on an Elba-shuttle Vehicle.
11 – Baggage
- 11.1 Allowed Luggage
  All passengers are allowed one suitcase and one carry-on included within the ticket fare per passenger:

  (handbag, briefcase, laptop, shop purchases, camera etc.)
  maximum dimensions of 55cm x 40cm x 20cm (115cm)
  Maximum Weight 5 Kgs
  
  Suitcase
  maximum dimensions of 50cm x 50cm x 50cm (150cm)
  Maximum Weight 20 Kgs
  
  All additional baggage in excess of permitted allowance will be required to be paid by buying an additional seat.
- 11.2 Lost/Damaged/Prohibited baggage
  - 11.2.1 – Demage - We will only be liable for any loss of or damage to your luggage and personal belongings caused by our negligence. Our maximum liability to you for any loss of or damage to your luggage whether for breach of contract, our negligence, or any deliberate or negligent acts of any of our employees, agents or representatives or otherwise, shall be limited to € 200,00 per passenger per Journey. You should insure your luggage with reputable insurers against all usual and normal risks of loss or damage to the full replacement value of the luggage.
  - 11.2.2 – Lost -
    If you leave or lose any of your luggage whilst travelling on an Servizio Elba-shuttle and the luggage is either found by or handed to a member of Elba-shuttle staff we shall take reasonable care of that luggage. Such luggage will be stored at such a location as we may decide but all such storage will be at the passenger’s risk. We may charge you a reasonable administration fee for the storage and return of your lost luggage.
    If you do not collect your lost luggage within 1 month of our receiving or finding it, we reserve the right to dispose of it in any manner we wish, including by destruction or sale and we shall be entitled to keep any sale proceeds. We shall be entitled to open and examine any left or lost luggage. If there are any items which we consider are dangerous or perishable or otherwise unsuitable for storage, we shall be entitled to dispose of such items within 48 hours of our receiving or finding them.
    If you find any property during en Elba-shuttle transfer belonging to someone else, you must hand it over to the driver immediately.
  - 11.2.3 - Prohibited -
    The prohibited items list for each route is as defined on the luggage allowance page of the website.
    Prohibited Items:
    Skis, Sailboards, Golf Clubs, Windsurfers and similar items.
    Wheelchairs (folding / non folding), Battery Powered Scooters.
    Bicycles (folding / non folding), Prams and Pushchairs (Non Folding).
    Weapons, Drugs (other than medicines), Solvents, Live or Dead Animals (other than as allowed under Article 2) Fish, Insects.
    Hazardous chemicals or substances as defined under the Health and Safety at Work Acts.
    Should a passenger present himself or herself for travel with any prohibited items, carriage will be denied unless the passenger properly and safely disposes of the prohibited item.
    Refunds will not be given to passengers who are denied permission to travel because they are in possession of prohibited items and are unable to dispose of them prior to travel.
- 11.3 – Sports equipment -
  If they are not declared on the booking, Elba Shuttle may refuse transport of objects that were not inserted in said form..
12 - Travelling with Pets -
We do not permit carriage of pets on our buses.
The only exception is Travelling with a Guide/Assistance Dog. We will make special arrangements for your Guide/Assistance Dog, to ensure they are able to travel with you in the bus.
Certified Assistance Dogs for blind, deaf or disabled passengers travel free of charge in the bus.
13 - Privacy
Information on Art. 13 of the D. Lgs. 196/2003 regarding the protection of personal data.
Elba Shuttle di Carpinacci Federico (hereupon known as Elba Shuttle), through its booking operations and their relative confirmation, acquires data relative to clients and/or passengers necessary to complete said booking, and/or for other firms which provide services for Elba Shuttle, for contractual obligations towards said clients and/or passengers (Art. 24 of the D. Lgs. 196/2003). Therefore, the above-mentioned data will be utilised exclusively for the purpose previously described, as well as the finalisation of managing the service, billing and processing, respecting the principle of propriety and legal disposition; the refusal to provide such data will not consent Elba Shuttle to execute its obligations. Personal data may be provided by Elba Shuttle to subjects whose responsibility it is to carry out activities necessary for the execution of transfers and given out exclusively for this finality. The client and/or passenger is protected under rights as stated in Art. 7 of the D.Lgs. 196/2003 and therefore at any time may: 1) Refuse the processing of personal data for legitimate reasons or in cases where the use of said data is for intended for publicity or direct sales, or for marketing research or commercial proposals, and to be informed at the moment in which the data is communicated and disseminated, of the possibility of freely exercising such a right; 2) request confirmation of the existence of said personal data at Elba Shuttle headquarters (even though he has not yet been registered) and their communication in an intelligible manner. A fee may be requested for every such request where the existence of data regarding the passenger requesting information is found to be non-existent. This fee will not exceed the cost born by Elba Shuttle; 3) obtain an indication of the origin of personal data, of the scope and manner of processing, as well as the logic applied in cases of processing effected utilising electronic equipment, of the identification of those responsible for the processing of said personal data, as well as subjects and categories of subjects to which personal data may be transmitted or gain access; obtain an update, correction or inclusion; request cancellation, conversion in an anonymous manner or access restriction to data processed, in violation of the law, including those which are not necessarily essential to maintain in order to fulfill the scope for which such data was provided and then processed, as well as obtaining attestation that said operations were carried out with the knowledge of those whose data was received or disseminated, except for cases in which such fulfilment was impossible or entails the use of means manifestly disproportionate to safeguarded rights. Obtaining the cancellation of personal data is subject to the dispatching of a written communication via fax, email or mail to the carrier's headquarters. Data will be kept for the period necessary to process accounting and taxes in accordance with the law but for a term of no longer than 10 years. Elba Shuttle di Carpinacci Federico is the holder of personal data processed and is legally represented in the person of Mr. Carpinacci Federico, with headquarters located on Via del Sighello snc, 57034 Campo nell’Elba (Italy).
